1. Introduction

Welcome to 3DBae. These Terms of Service ("Terms") govern your access to and use of the 3DBae platform, including our website, services, and tools (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the Service.

3DBae is a platform that enables users to upload, customize, and embed interactive 3D models on websites without coding. We offer both free and premium subscription plans with different features and capabilities.

2. Definitions

"User," "you," and "your" refer to the individual or entity that has agreed to these Terms by accessing or using the Service.

"3DBae," "we," "us," and "our" refer to the company operating the Service.

"Content" refers to any 3D models, images, text, information, data, or other materials uploaded to or made available through the Service.

"Project" refers to a collection of 3D models and settings created by a User within the Service.

3. Account Registration and Eligibility

To use certain features of the Service, you must register for an account. When you register, you will be required to provide accurate, current, and complete information about yourself and keep this information up to date.

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service. By using the Service, you represent and warrant that you meet these requirements.

The registration process includes email verification. Your account will be created after you verify your email address through the verification link sent to your provided email.

4. Service Plans and Features

3DBae offers both free and premium subscription plans:

• Free Plan: Includes 100MB of storage, ability to create 1 project with up to 2 models, and displays a 3DBae watermark on the embedded viewer.
• Premium Plan: Available for $8/month, includes 2GB of storage, unlimited projects and 3D model uploads, and no watermark on the embedded viewer.

We reserve the right to modify, suspend, or discontinue any aspect of our Service plans at any time, including changing the features, storage limits, or pricing. We will provide notice of significant changes to premium subscribers via email.

5. Payment Terms and Order Process

Premium subscriptions are billed monthly at the rate specified at the time of purchase. By subscribing to a Premium Plan, you authorize us to charge your payment method on a recurring basis until you cancel your subscription.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

All payments are non-refundable except as expressly set forth in these Terms or as required by applicable law. Fees are exclusive of taxes, which we will charge as applicable.

You may cancel your subscription at any time through your account settings. Upon cancellation, you will continue to have access to Premium features until the end of your current billing cycle. After this period, your account will revert to the Free Plan, which may result in limited access to previously created projects and models that exceed Free Plan limits.

We reserve the right to change our pricing at any time. If we change the pricing for your subscription plan, we will provide notice of the change through your account or via email at least 14 days before the change takes effect.

6. Refund Policy

3DBae offers a 14-day money-back guarantee for our Premium Plan. If you are not satisfied with our service, you may request a refund within 14 days of your initial purchase by contacting our support team at connect@3dbae.com.

Refund requests made after the 14-day period will be evaluated on a case-by-case basis and are not guaranteed. No refunds will be provided for partial subscription periods or for accounts that have violated our Terms of Service.

Please note that as Paddle.com is our Merchant of Record, all refunds will be processed through Paddle's system in accordance with their policies and procedures.

7. User Content and Licensing

You retain all rights to the 3D models and other content you upload to the Service. By uploading content to 3DBae, you grant us a worldwide, non-exclusive, royalty-free license to host, store, transfer, display, and create derivative works of your content solely as necessary to provide the Service to you and your viewers.

You represent and warrant that you own or have obtained all necessary rights, licenses, consents, and permissions to upload, share, and display your content through the Service, and that your content does not violate the intellectual property rights, privacy rights, or any other rights of any third party.

We do not claim ownership of your content, and we will not use your content for any purpose other than providing the Service, unless you explicitly grant us additional permissions.

8. Prohibited Content and Activities

You agree not to upload, create, or share any content that:

• Infringes on intellectual property rights of others
• Contains sexually explicit, pornographic, or offensive material
• Promotes violence, discrimination, or illegal activities
• Contains malware, viruses, or harmful code
• Violates or encourages violation of these Terms or any applicable laws

Additionally, you agree not to:

• Attempt to bypass any technical limitations or security measures of the Service
• Use the Service for any illegal purpose or in violation of any applicable laws
• Impersonate others or misrepresent your identity or affiliation
• Interfere with or disrupt the operation of the Service or servers connected to the Service

We reserve the right to remove any content and suspend or terminate accounts that violate these prohibitions, at our sole discretion.

9. Intellectual Property Rights

The Service, including its software, design, text, graphics, logos, and other content (excluding User Content), is owned by 3DBae and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

The 3DBae name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of 3DBae or its affiliates. You may not use these marks without our prior written permission.

Feedback, suggestions, or ideas provided by you regarding the Service may be used by us without any obligation to compensate you, and you grant us a perpetual, worldwide, fully transferable, sublicensable, irrevocable, fully paid-up, royalty-free license to implement, use, modify, and commercialize your feedback in any way.

10. Data Storage and Security

We implement reasonable security measures to protect your content and account information. However, no method of transmission or storage over the Internet is 100% secure, and we cannot guarantee absolute security.

Free accounts are limited to 100MB of storage space, and Premium accounts are provided with 10GB of storage space. If you exceed your storage limit, you may not be able to upload additional content until you reduce your storage usage or upgrade your plan.

We may establish general practices and limits concerning the use of the Service, including the maximum file size, number of models per project, and storage space allocated to your account. We reserve the right to change these practices and limits at any time.

11. Service Availability and Support

We strive to ensure that the Service is available at all times, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, upgrades, or factors beyond our control.

Support for the Service is provided on a best-effort basis. Premium subscribers may receive priority support. We do not provide technical support for integrating the embedded viewer into third-party websites beyond our documentation.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND QUIET ENJOYMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT DEFECTS WILL BE CORRECTED.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL 3DBAE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SERVICE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY FOR CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

14. Indemnification

You agree to indemnify, defend, and hold harmless 3DBae and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses, including reasonable attorneys' fees, arising out of or related to your use of the Service, your content, or your violation of these Terms or any applicable laws.

15. Term and Termination

These Terms remain in effect while you use the Service or maintain an account. You may terminate these Terms at any time by canceling your account and ceasing all use of the Service.

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violations of these Terms, illegal activities, or upon request from law enforcement or other government agencies.

Upon termination, your right to use the Service will immediately cease, and we may delete or remove your content and account information. Sections of these Terms that, by their nature, should survive termination shall survive, including provisions regarding intellectual property, disclaimers, limitations of liability, and indemnification.

16. Privacy

Your privacy is important to us. Our Privacy Policy, available at https://www.3dbae.com/privacy-policy, explains how we collect, use, and disclose information about you. By using the Service, you consent to our collection, use, and disclosure of information as described in our Privacy Policy.

17. Modifications to the Terms

We reserve the right to modify these Terms at any time. If we make material changes to these Terms, we will provide notice through the Service, via email, or by other means to provide you with the opportunity to review the changes before they become effective.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service.

18. General Provisions

Entire Agreement: These Terms constitute the entire agreement between you and 3DBae regarding the Service and supersede all prior agreements and understandings.

Governing Law: These Terms shall be governed by and construed in accordance with the laws of California, USA, without regard to its conflict of law principles.

Dispute Resolution: Any disputes arising from or related to these Terms or the Service shall be resolved through binding arbitration in California, USA, except that you or 3DBae may seek injunctive relief in any court having jurisdiction.

Waiver and Severability: The failure of 3DBae to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced.

Assignment: You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. 3DBae may assign or transfer these Terms without restriction.
